Register a Trademark
By registering a trademark, a business can distinguish its products and services from those of others and protect its rights to them.
Note: Use browser translation for English version
The trademark registration application must be submitted to the Intellectual Property Office of the Ministry of Economy of the Republic of Armenia. The application must include the following:
- Information identifying the applicant or their representative
- A clear image of the proposed mark (or, in the case of a sound trademark, a musical notation) and a description
- A list of the goods and/or services for which the trademark is to be registered, grouped according to the current Nice Classification, in ascending order of class numbers
- An indication of whether the mark is three-dimensional, holographic, or a sound mark; if color is a distinctive feature; and if there are any non-retainable elements.
Necessary to Provide:
- The transcription of the mark or its verbal parts and its Armenian translation
- A statement that the mark is a collective certification mark
- A statement of the date of the requested priority and its grounds
- A statement that the applied-for mark is three-dimensional, holographic, or sound
- A statement that the color combination is a distinctive feature of the trademark
- A statement of the elements of the applied for mark that are considered unprotectable
- A statement of the transcription of the mark or its verbal elements and their Armenian translation
- A statement that the applied-for mark is a collective mark
- A statement that the applied-for mark is a certification mark
- A statement of the date of the requested priority and its grounds (if applicable)
Required Documents
- Permission issued by the competent authority in cases provided for by the Law "On Trademarks"
- Consent issued by the right holder in cases provided for by law
- Regulations on the use of a collective mark
- Regulations on the use of a certification mark
Necessary to Attach:
- A receipt for payment of the state fee prescribed by law for submitting an application and conducting an examination, as well as a receipt for payment of an additional state fee for each class in case of more than one class, and if the state fee was paid at a discount, a certificate on the number of employees as of the date of payment of the state fee is also submitted.
- A document confirming the powers of the applicant's representative if the application was submitted through a representative.
- As well as, in appropriate cases:
- An application for requesting priority
- Permission and consent issued by the competent authority in cases provided for by law
- The regulations on the collective mark
- The regulations on the use of the certification mark
When attaching documents in another language, applicants registered in the Republic of Armenia must also provide their Armenian translation at the time of submitting the application, while foreign applicants may provide it within 2 months from the date of applying.
If the application is being filled out through a representative, you must have a document confirming their authority.
Payment Amount and Procedure
- For submitting an application: 30,000 AMD
- For conducting an examination: 40,000 AMD
- For each class exceeding one: 15,000 AMD
The Following Discounts Apply
- In the case of individuals, legal entities, or individual entrepreneurs with up to 25 employees, the application fee is 7,500 AMD, the examination fee is 10,000 AMD, and the additional class fee is 3,750 AMD.
- In the case of legal entities or individual entrepreneurs with 25 to 100 employees, the registration application fee is 15,000 AMD, the examination fee is 20,000 AMD, and the additional class fee is 7,500 AMD.
- In the case of legal entities or individual entrepreneurs with more than 100 employees, the registration application fee is 30,000 AMD, the examination fee is 40,000 AMD, and the additional class fee is 15,000 AMD.
Moreover, when applying for trademark registration, the required state fees must be paid in advance, and payment receipts must be attached to the application.
Delivery Period and Procedure
The examination of the submitted application is conducted in two stages:
- A preliminary examination of the application is conducted within 10 working days after the date of filing the application
- A substantive examination of the application is conducted within 3 months from the date of publication of the application.
The total period for receiving, registering, considering, and issuing a trademark application is 5 months.
The term of a trademark registration is 10 years from the filing date.
